These Terms of Service ("Terms") are an agreement between you and [LEGAL ENTITY], [REGISTERED ADDRESS] ("Bella", "we", "us"). They apply when you create an account, build or publish a website, or sell through a store with Bella Studio AI (the "Service"). By creating an account you agree to these Terms and to our Privacy policy.

1. Your account

You must be at least 18, or the age of majority where you live, and able to enter a contract. Keep your sign-in details secure and tell us at [SUPPORT EMAIL] if you think someone else has used your account. You are responsible for everything done through your account.

2. Your sites and content

You keep ownership of everything you upload or create with the Service, including content Bella's AI generates for you ("Your content"). You give us a worldwide, non-exclusive licence to host, copy, process and display Your content only as needed to run the Service, for as long as you keep it on Bella.

You are responsible for Your content and your published sites, including:

• that you have the rights to everything you publish, such as text, photos, logos and music;
• that your site is accurate and lawful where it is offered, including any privacy notice, consumer, accessibility or advertising rules that apply to your business;
• reviewing anything Bella's AI generates before you publish it, as described in our AI use policy.

Visitors to your site are your visitors. For their personal data, you are the controller and Bella processes it on your behalf to host your site.

3. Acceptable use

You may not use the Service to publish or generate content that is illegal, deceptive, defamatory, hateful, sexually exploits anyone, infringes someone else's rights, impersonates a person or business, distributes malware, or collects personal data without a lawful basis. You may not attack, overload, scrape or reverse-engineer the Service, or resell it without our written permission. The AI use policy adds rules for AI-generated content.

We may remove content or suspend a site or account that breaks these Terms, and we will tell you why unless the law or safety prevents it.

4. Sellers

If you take payments through a store on your site, you are a "Seller" and this section also applies.

• Payments are processed by Stripe. Before you connect Stripe you must accept the Stripe Connected Account Agreement, which governs your relationship with Stripe. Bella is not a party to your sales.
• You are the seller of record. You are responsible for your products and services, their descriptions and prices, fulfilment, refunds, returns, chargebacks, customer support and any warranties.
• You are responsible for collecting, reporting and paying all taxes on your sales, and for any licences your business needs.
• You must publish your own terms of sale, refund policy and contact details where the law requires them.
• You may not sell anything that Stripe's restricted business list or the law prohibits.

5. Fees

Parts of the Service may be free. If we introduce paid plans, we will show the price, billing period and renewal terms before you subscribe, and you can cancel before the next renewal. Any Stripe or payment processing fees are charged by Stripe under its own terms.

6. Availability and changes

We work to keep the Service available, but we do not promise it will be uninterrupted or error-free. We may change or discontinue features. If we discontinue the Service, we will give you reasonable notice and a way to export your content where we can.

We may update these Terms. For a material change we will ask you to accept the new version before you keep using the Service. For minor changes, such as clarifications, we will update the effective date.

7. Ending your account

You can delete your account at any time from your account settings. Deleting your account takes down your published sites and deletes your content, except where the law requires us to keep records. We may end or suspend your account if you seriously or repeatedly break these Terms.

8. Disclaimers and liability

The Service is provided "as is". To the extent the law allows, Bella is not liable for indirect or consequential losses, lost profits or lost data, and our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and USD 100.

Nothing in these Terms limits liability that cannot be limited by law, or any rights you have as a consumer under the law where you live.

9. Governing law

These Terms are governed by the laws of [GOVERNING JURISDICTION], unless the law where you live gives you the right to rely on its laws or courts.
